These Terms of Service ("Terms") govern your access to and use of the website trustpointleads.com and the lead generation services provided by Trustpoint Leads ("we," "us," or "our"). By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1. Who May Use Our Services
Our lead generation services are intended solely for licensed insurance professionals, agents, and agencies. By purchasing or using our services, you represent and warrant that:
- You hold all licenses required to sell or solicit insurance in the states where you operate
- You are at least 18 years of age and legally able to enter into these Terms
- You will comply with all applicable federal, state, and local laws, including the Telephone Consumer Protection Act (TCPA), Do-Not-Call regulations, and CMS marketing rules where applicable
- All information you provide to us is accurate and current
2. Nature of Our Services
Trustpoint Leads provides marketing and lead generation services. We generate consumer inquiries ("leads") and deliver them, along with live transfers and pre-closed applications, to licensed agents.
We are not an insurance company or agency. We do not sell insurance, provide quotes, offer coverage advice, or enroll consumers. We are not affiliated with or endorsed by Medicare, CMS, or any government agency. We make no representation that any lead will result in a sale, appointment, or enrollment.
3. Orders, Pricing & Payment
Orders
Lead volume, markets, delivery format, and pricing are agreed between you and Trustpoint Leads before delivery begins. Availability is subject to state and partner capacity caps and may be waitlisted.
Pricing
Prices are as quoted at the time of your order and may vary by market, state, delivery format, and volume. Pricing for Medicare and ACA products may fluctuate during enrollment periods. We reserve the right to change pricing on a prospective basis with reasonable notice.
Payment
Payment terms are established during onboarding. Unless otherwise agreed in writing, orders are prepaid, and delivery draws against your available balance. Failure to maintain payment may result in suspension or termination of delivery.
Please confirm this section matches your actual billing model before publishing β prepaid balance, invoicing, terms, etc.
4. Lead Delivery & Exclusivity
Leads are delivered in real time to the agent or agency who ordered them. Leads marked as exclusive are delivered to a single agent and are not resold or redistributed by us.
While we take reasonable steps to generate and verify high-quality, consent-based leads, we do not guarantee that any lead will be reachable, interested, eligible, or that it will convert. Lead quality is affected by factors outside our control, including your speed to contact, follow-up process, and sales approach.
5. Returns, Credits & Refunds
Because leads are perishable and delivered in real time, all sales are generally final. However, we may issue a credit for leads that fail to meet basic validity criteria, such as:
- Disconnected or invalid phone numbers
- Duplicate records delivered in error
- Clearly false or non-genuine data
- Leads outside the agreed market or geography
Credit requests must be submitted within the timeframe specified in your onboarding agreement. We do not issue credits for leads that are simply unresponsive, decline to purchase, change their mind, or where the outcome reflects sales performance rather than lead validity.
Confirm your exact return window and policy (e.g. "within 24 hours," "within 7 days") and edit this section to match. This is a common source of disputes if it doesn't reflect your real terms.
6. Your Responsibilities & Compliance
You are solely responsible for how you contact and communicate with leads delivered to you. You agree to:
- Comply with all applicable laws, including the TCPA, TSR, state Do-Not-Call and telemarketing laws, and CMS marketing guidelines
- Honor all opt-out, do-not-call, and unsubscribe requests
- Use leads only for lawful insurance marketing purposes
- Not resell, redistribute, or share leads we provide with any third party
- Maintain your own compliance records as required by law
You are responsible for your own compliance. Trustpoint Leads provides consent records with leads, but you are independently responsible for how you use each lead and for adhering to all laws governing your outreach.
7. Prohibited Conduct
You agree not to:
- Resell, sublicense, or redistribute leads provided by us
- Use our services for any unlawful, fraudulent, or deceptive purpose
- Misrepresent your licensing, identity, or business
- Attempt to disrupt, damage, or gain unauthorized access to our website or systems
- Copy, scrape, or replicate our website, campaigns, or proprietary materials

9. Disclaimer of Warranties
Our website and services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that leads will convert, that our services will be uninterrupted or error-free, or that any specific results will be achieved.
10. Limitation of Liability
To the fullest extent permitted by law, Trustpoint Leads shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or relating to your use of our website or services. Our total aggregate liability for any claim arising out of these Terms or our services shall not exceed the amount you paid to us for the specific leads or services giving rise to the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Trustpoint Leads and its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of our services, your contact with leads, your violation of these Terms, or your violation of any law or third-party right β including any TCPA, Do-Not-Call, or CMS-related claims arising from your outreach.
12. Termination
We may suspend or terminate your access to our services at any time, with or without notice, if you violate these Terms, fail to maintain payment, or engage in conduct we determine to be harmful to us, our partners, or consumers. Upon termination, any outstanding obligations survive.
13. Governing Law & Disputes
